General Terms and Conditions (GTC)

§1 Scope of Application
These General Terms and Conditions govern the use of LegalBrandCheck (legalbrandcheck.com), an automated business-name screening service operated by Trabos Digital Matrix (sole proprietorship), owner Astrid Trabos, Hänkelbodenstrasse 1, 8173 Neerach, Switzerland.
LegalBrandCheck provides exclusively technical screening services. The results do not constitute legal advice or trademark advice.
§2 Description of Services
LegalBrandCheck screens submitted business names across six dimensions:
- Domain availability
- Social media handles
- Trademark registers (TMview, WIPO, USPTO)
- Likelihood-of-confusion analysis
- Company registers (OpenCorporates)
- Legally restricted terms
All results are based on automated queries of publicly accessible registers at the time of retrieval. No guarantee is given for completeness, accuracy or currency.
§3 Terms of Use
- Use requires legal age (at least 18 years); legal entities must have legal capacity to act.
- Commercial use (including resale of screening results) is permitted only with an active subscription.
- Reverse engineering, automated scraping or abusive bulk queries are prohibited.
- Using the platform for unlawful purposes is prohibited.
§4 Plans & Payment
Day pass — CHF 4.90
One-time purchase. Access to all screening features for 24 hours (until midnight of the day of purchase, Swiss time). No subscription, no automatic renewal.
Week pass — CHF 9.90
One-time purchase. Access to all screening features for 7 days from the date of purchase. No subscription, no automatic renewal.
Monthly subscription — CHF 14.90/month
Monthly recurring subscription. Automatically renews for one further month at a time. Cancellation is possible at any time, effective at the end of the current billing period — via the account on legalbrandcheck.com or the Stripe customer portal.
Enterprise / API — USD 199/month
Monthly recurring subscription. Includes API access and a monthly request quota; usage beyond that is billed per consumption. Renews monthly; cancellation effective at the end of the current period.
Trademark Watch Single — CHF 39/year
Annually recurring subscription for monitoring one trademark. Automatically renews for one further year at a time; cancellation effective at the end of the current annual period.
Trademark Watch Multi — CHF 129/year
Annually recurring subscription for monitoring up to ten trademarks. Automatically renews for one further year at a time; cancellation effective at the end of the current annual period.
All prices include statutory value-added tax. Payment is processed via Stripe (credit card). We do not store any payment card data.
Refunds for current periods are generally excluded. EU consumers are entitled to the statutory right of withdrawal — details and the model withdrawal form are set out in the withdrawal notice referenced above. The right of withdrawal expires once performance has begun with explicit consent (Art. 16(m) of Directive 2011/83/EU).
§5 Limitation of Liability
Screening results do not replace legal or trademark advice. Trabos Digital Matrix accepts no liability for damages arising from reliance on screening results.
The maximum liability of Trabos Digital Matrix is in any case limited to the amount of the affected user's last three monthly payments.
§6 Data Protection
The Privacy Policy of LegalBrandCheck applies.
§7 Domain Registration
Via legalbrandcheck.com, users can register domains directly. Payment is processed via Stripe (see §4); technical registration occurs automatically through one of the registrar partners Cloudflare, Inc. or Dynadot Inc. (selection depends on the chosen domain extension, see Privacy Policy section 2.3a). Trabos Digital Matrix acts as intermediary/reseller in this process; the contracting party for the domain registration itself is the respective registrar. Domain registration links may in individual cases also be affiliate deep links to third-party providers, for which Trabos Digital Matrix may receive a commission.
§8 Intellectual Property
Screening reports may be used for internal own use. Resale or commercial distribution of screening reports is prohibited without express written permission.
§9 Governing Law & Jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Neerach ZH, Switzerland. For consumers resident in an EU member state, the mandatory consumer protection law of their state of residence applies; the place of jurisdiction is the court of their place of residence.
§10 Changes to these Terms
Trabos Digital Matrix may amend these Terms with 30 days' notice by email. Continued use of the platform after expiry of this period constitutes acceptance of the amended Terms.
