What does it really cost?

What is included in the free check?

You see the traffic light per source and immediately recognise whether there are hits. Without account and without credit card. What is missing is the verifiable element: the PDF report with source references, timestamp and checksum as well as the detailed similarity analysis.

Does this replace a trade mark attorney?

No. This is automated research, not legal advice. For a binding assessment, you need a trade mark attorney. The report is the preparatory work for this — it delivers the same register data that law firms also start with and saves the hours that would otherwise be billed for it.

Which countries are actually checked?

Automated checks cover the connected sources, including EUIPO for EU trademarks, USPTO for the United States, DPMA for German national trademarks and Zefix for the Swiss commercial register. The 197 jurisdictions in the directory are a reference resource with trademark office, filing route and country domain — they are not checked automatically. The report records which registers were checked and which were not.

What happens to my data?

LegalBrandCheck is a Swiss provider, hosted in the EU. Swiss clients can choose to have their data stored in Switzerland. The checked name is not sold to third parties and not used for advertising.

How current is the data?

The data comes from the sources at the time of your query, not from a purchased intermediate database. The timestamp in the report records the moment. Registers change daily — therefore a report is valid for the day on which it was created.

What do I do if there is a hit?

A hit is an indication, not a decision. The report shows how similar the found trade mark is and in which class it is registered. With this, you go to a trade mark attorney who assesses whether a conflict really exists. Often the answer is to slightly modify the name or choose a different class.

Why this if I can search the register for free?

A register search finds identical names in one register. However, conflicts usually arise from similarity, not identity — and rarely in only one register. Here, trade mark registers, domains, handles on seven platforms, company registers and sanctions lists come together in one run, with a similarity analysis by sound, meaning and visual appearance.
