Does LegalBrandCheck also check the Nice classes (goods/services classes)?

Accepted Answer

Yes. The report compares not only name similarity but also the goods/services classes (Nice classes) of every mark found against your own class selection. A critical or high risk is only shown when name, class AND territory all match — an identical or similar name in a completely different industry is rated correspondingly lower, not reported as a blanket conflict. You can see the class match directly in the report: on the "Nice Classes" tab, in the trademark comparison table and in the similarity overview — not hidden, but part of the visible result. If a source doesn't provide class information for a hit, we explicitly flag that in the report as "not confirmed by source" rather than silently assuming a match.

Does LegalBrandCheck also detect older, unregistered usage rights (prior-use rights)?

Accepted Answer

Not completely — we say so openly. A gapless check of unregistered prior-use rights would require a worldwide press and web search across every industry; no automated tool delivers that fully today, LegalBrandCheck included. What we do provide are several structured partial signals that can indicate real use by third parties: active commercial register entries (Zefix for Switzerland live, direct registers for the UK, Ireland, France, Finland and Norway, plus OpenCorporates worldwide), domain registrations including age and squatting indicators, availability of social media handles (Instagram, X, LinkedIn, TikTok, YouTube, GitHub, Facebook) and presence in app stores (Apple App Store, Google Play). These signals improve your basis for decisions but do not replace an attorney's research into older, unregistered rights. You can additionally timestamp your own first use in the First-Use Vault — this protects your own later evidence, but does not replace a search for someone else's prior use. For a conclusive review we still recommend a specialist.
